Trailer Lessor Terms and Conditions These Terms & Conditions are a binding legal agreement between you, herein referred to as ("I") or ("Lessor") and Trailer On Demand LLC and its subsidiaries, representatives, and affiliates, herein referred to as ("Owner"), that govern the right to use website(s), platforms, and other offerings from Owner. Owner is granting Lessor a limited revocable license to use the Trailer On Demand website (“Platform”) subject to the Terms and Conditions as follows. The Owner enables users to publish and offer trailer rental services on the Platform, herein referred to as “Lessor(s)”. The Owner enables users to purchase trailer rental services on the Platform, herein referred to as “Lessee(s)”. As a provider of the Platform, Owner does not own, control, offer, or manage any trailer or trailer rental listings or services. Owner is not a party to the contracts entered into directly between Lessor(s) and Lessee(s). Owner is not acting as an agent, representative, joint venturer, or partner in any capacity for any Lessor or Lessee. I certify that I am at least 25 years of age upon listing a trailer on the Platform for rental and am legally permitted to do so. Upon listing a trailer on the Platform for rental, I understand that I will assume full responsibility for the trailer and the leasing of the trailer. I understand that it is my responsibility to furnish a trailer in working order that meets the specifications I list on the Platform and that the trailer is in compliance with all applicable laws. I agree that the trailer shall only be used for lawfully hauling and storing items. I shall provide my consent in writing to any Lessee prior to granting trailer use for any lawful purpose other than hauling and storing items. I will not allow anyone other than Lessee tow or use the trailer during the term of Lessee’s rental. Contracts between Lessor and Lessee will be of lease only and not of sale. I agree that any trailer I lease to a Lessee will at all times remain the property of Lessor. I reserve the right to repossess my trailer from a Lessor if the trailer is abandoned or used in violation of law or these Terms and Conditions. I agree to indemnify Owner, defend Owner, and hold Owner harmless from all claims, liability, costs and attorney fees Owner incurs or that are asserted against Owner resulting from, or arising out of, rental and use of the trailer, including but not limited to theft, damage, injury, or misuse of the trailer. OWNER MAKES NO WARRANTIES, EXPRESS, IMPLIED OR APPARENT, REGARDING THE TRAILER, NO WARRANTY OF MERCHANTABILITY AND NO WARRANTY THAT THE TRAILER IS FIT FOR A PARTICULAR PURPOSE. TRAILER IS PROVIDED “AS IS”, AND THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED.

I understand that I am required to have insurance on any trailer that I list on the Platform at my expense with no less coverage than the amounts required under state law. I understand that Owner encourages Lessors to insure their trailers through MBA. I consent to verification of my trailer(s) insurance through canopy connect or any other verification service required by Owner. All rentals are final. I understand that once payment is completed, services are considered rendered. Owner reserves the right to grant refunds to Lessee on a case-by-case basis. If a Lessee does not return the trailer on time, the Lessee’s payment method will be charged a late fee, the greater of $200 or the amount of the rental booking(s) following Lessee’s booking, that is/are not able to be completed due to the trailer not being available for the next reservation(s). I consent and allow Owner and/or its third-party payment processor to keep my payment information and payment method, including but not limited to credit card(s) and debit card(s), on file for future use. Owner and/or its third-party payment processor may use my payment information and charge my payment method in the future for subscription fees, issuing refunds, payment of damages, late fees, or other losses incurred during the rental of the trailer. All transactions are final. I consent to Owner collecting payment in the amount of 10% of the total charged for each rental. Additionally, I agree to pay the monthly subscription fee in order to access and lease my trailer(s) on the Platform. I understand that Lessee, not Owner, is responsible for damages loss, including theft of the trailer and any property placed inside the trailer, including damage caused by weather, road conditions, and acts of nature during the rental period. Lessee is responsible for the cost of repair or the actual retail cash value of the trailer if it is not repairable or if Lessor elects not to repair it. Lessee is also responsible for any missing equipment and a reasonable charge to cover any administrative expenses connected with any damage claim. I may charge Lessee a cleaning fee of up to $200.00 if the trailer is not returned in its original condition, less ordinary wear. Owner is not responsible for any injuries, accidents, damages, or death of any persons, animals, or contents, while in or out of the trailer. I release Owner, as well as its Owners, employees, affiliates, agents, successors and assigns (the “Owner released Parties”), from any and all liability, claims, demands, actions or causes of action whatsoever both in law and in equity, in any way resulting from personal injuries, conscious suffering, death, or property damage sustained by me or by others arising out of use of the trailer, even if caused by the negligence of one or more of the Owner Released Parties, but not if caused by the intentional or reckless acts or omissions of the Owner Released Parties. Use of the Platform and/or trailer is subject to the terms of Owners Privacy Policy which Is hereby incorporated into and made part of this agreement. I represent and warrant that all information I provide to Owner and/or Lessor is true and correct.

I have read each part of the Terms and Conditions, and I agree to the Terms and Conditions. I am responsible for compliance with these Terms and Conditions. Owner maintains the right to remove me from Trailer On Demand Platform for any reason including violation of these Terms and Conditions.
